PRIVACY NOTICE

  1. INTRODUCTION

    We at CHEMSAIN GROUP OF COMPANIES respect your privacy and are committed to protecting the personal information that you share with us. As per the Personal Data Protection Act 2010 (“PDPA”) enacted by the government to regulate the processing of personal data in commercial transactions, we have as such issued out this Privacy Notice (“Notice”) to all our valued customers and/or prospective customers and/or business partners in accordance with the PDPA and the personal data protection principles that are set out within, explaining how we collect, handle and use your personal data. This notice also describes how we collect and use any personal information you provide in order to provide you with our services.
  2. RIGHT TO AMEND
    1. CHEMSAIN GROUP OF COMPANIES reserve the right to update, revise, vary, amend and/or modify this Notice from time to time. Any material changes will be posted on our website with the updated Notice or through other appropriate means. If CHEMSAIN GROUP OF COMPANIES amends this Notice, the amendment will only apply to personal data collected after CHEMSAIN GROUP OF COMPANIES has posted the revised Notice. By continuing to communicate with CHEMSAIN GROUP OF COMPANIES or by continuing to use CHEMSAIN GROUP OF COMPANIES’s services following the modifications, updates or amendments to this Notice, it shall signify your acceptance of such modifications, updates or amendments.
    2. In accordance with Section 7(3) of the PDPA, this Notice is issued in both English and Bahasa Malaysia. In any event of conflicts or discrepancies between the English version and the Bahasa Malaysia version, the English version shall prevail.
  3. DATA COLLECTED
    1. “Personal Data”, “Sensitive Personal Data” and “Data Subject” have their respective definitions as more particularly stipulated under the PDPA.
    2. The Personal Data that we collect includes but is not limited to the following:

      Customers
      • personal details such as name, IC number, age, birth date, race, address, gender, occupation, telephone number, mobile telephone number, email address, credit card number(s) etc;
      • your image by way of video surveillance installed in certain parts of our premises as part of our security infrastructure;
      • your image captured by camera or video when you attend promotional or other events held at our premises or otherwise organized by us, or captured as part of a promotional contest or other marketing activities; and/or
      • information automatically collected when you visit our website such as IP address, web browser, software, transaction information and other information. 

      Business Partners (agents, affiliates, vendor, supplier, tenant or service providers)
      • your personal details or that of your employees such as name, IC number, address, gender, telephone number, mobile telephone number and email address, and other details as is necessary for the conduct of the business transaction between you and us;
      • when you visit our premises, your image by way of video surveillance in certain parts of our premises as part of our security infrastructure;
      • your image captured by camera or video when you attend promotional or other events held at our premises or otherwise organized by us; and/or
      • information automatically collected when you visit our website or use the platforms that we provide to our business partners for the purpose of conducting the relevant business transaction between you and us, such as IP address and other information.
    3. The provision of your Personal Data to CHEMSAIN GROUP OF COMPANIES may be voluntary or mandatory in nature depending on the purposes for which your Personal Data is collected. Where it is mandatory for you to provide us with your Personal Data, and you fail or choose not to provide us with your Personal Data, or do not consent to this Notice, we may not be able to:

      Customers
      • conduct or complete the relevant sale and purchase transaction (including online transactions) with you;
      • process or perform your request;
      • process your application for booking venues and events;
      • to communicate with you including to respond to any of your queries and/or requests; and/or
      • provide you with the information, updates, products or services that you have requested.

      Business Partners (agents, affiliates, vendor, supplier, tenant or service providers)
      • conduct or complete the relevant business transaction with you;
      • allow you entry into our premises or events, for security purposes; and/or
      • allow you use of our platforms provided to our business partners.
    4. If you do not want your Sensitive Personal Data to be collected by us, please do not submit it. If you do choose to submit your Sensitive Personal Data to us as requested, such data shall then be deemed to be and will be treated by us as Personal Data which will be subject to the terms and scope of this Notice including for the collection, processing, use and disclosure of your Personal Data.
  4. HOW IS YOUR PERSONAL DATA BEING COLLECTED
    1. CHEMSAIN GROUP OF COMPANIES will collect personal data when carrying out one or more of its functions or activities. We will only collect personal data in a lawful and fair manner that is not unduly intrusive.
    2. We will collect personal data about an individual directly from the individual if it is reasonable and practical to do so. We may also collect personal data from other sources, such as events, conferences, seminars, or talks organised or sponsored by CHEMSAIN GROUP OF COMPANIES, and/or cookies used on this website.
    3. In addition to the personal information you provide, we collect and use anonymous data from your internet browser and device via cookies, services logs, third party website analytical companies, and other similar technologies. We use this information to better understand how our services are used so that we can determine how to improve them and provide more relevant content to you.

      • when you enter contests or respond to our surveys, promotions or questionnaires, whether in physical hardcopy or electronic copy;
      • pursuant to any inquiry, complaint, request or communication made with or to us, whether in physical hardcopy or electronically (including through our website or other platforms);
      • when you visit our premises or attend events organized by us (in relation to CCTV images, other camera/ video images and other personal details collected for security purpose);
      • when you submit your information on our website; and / or
      • through the use of cookies on our website and other internet platforms.
      Business Partners (agents, affiliates, vendor, supplier, tenant or service providers)
      • when you send us completed application forms, workers’ list, and any other forms, documents or details pursuant to any business transaction or proposed business transaction with us, whether in physical hardcopy or electronic copy;
      • when you visit our premises or attend events organized by us (in relation to CCTV images, other camera/ video images and other personal details collected for security purpose); and/or
      • through the use of cookies on our website, and also through the use of other platforms provided to our business partners.
    5. If you do not want your Sensitive Personal Data to be collected by us, please do not submit it. If you do choose to submit your Sensitive Personal Data to us as requested, such data shall then be deemed to be and will be treated by us as Personal Data which will be subject to the terms and scope of this Notice including for the collection, processing, use and disclosure of your Personal Data.
    6. We may also receive personal information from business partners and vendors on occasion, if such parties have obtained your permission to do so. In such cases, all personal information will be treated as confidential, as specified in this policy.
  5. PURPOSE OF INFORMATION COLLECTED
    1. We may use your personal information to help us provide you with our services, to protect our legitimate interests, or to comply with regulatory requirements.
    2. We only use such information if it was obtained in accordance with acceptable privacy practices in accordance with this Policy and applicable laws, specifically the PDPA.
    3. CHEMSAIN GROUP OF COMPANIES may use and process your Personal Data for the purposes relating to the services you have requested and for the business activities of CHEMSAIN GROUP OF COMPANIES which shall include:

      • to communicate with you, including in relation to our products, contests and events;
      • to process your applications, inquiries, requests and purchases (including online transactions, if applicable);
      • to provide information, updates on our, or other, products and services;
      • for database(s) record keeping, maintenance and updating;
      • for administrative purposes including audits, fraud monitoring and prevention of crime;
      • to conduct research and statistical analysis;

      • to ensure the security and safety of the premises (in relation to CCTV images and other details collected for security purposes);
      • for credit card application with financial institutions, only as allowed by you (in cases of joint campaigns and promotions);
      • to comply with any applicable laws, proceedings or inquiries from regulatory authorities and enforcement agencies; and / or
      • for all other purposes incidental and associated with any of the above and/or required or permitted under the PDPA.
      Business Partners (agent, affiliates, vendor, supplier, tenant or service providers)
      • to fully and properly conduct the relevant business transaction with you;
      • to process any payment related to the relevant business transaction with you;
      • for insurance purposes;
      • for database(s) record keeping, maintenance and updating;
      • for administrative purposes including audits, fraud monitoring and prevention of crime;
      • to ensure the security and safety of the premises (in relation to CCTV images and other details collected for security purposes);
      • to promote our products and services offered by us from time to time, and our company (in relation to images and other Personal Data captured during attendance at events organized by us);
      • to comply with any applicable laws, proceedings or inquiries from regulatory authorities and enforcement agencies; and / or
      • for all other purposes incidental and associated with any of the above and/or required or permitted under the PDPA.
      And/Or generally: -
      • to establish your identity and background;
      • to administer and communicate with you;
      • for internal record keeping;
      • for financial purposes, including accounting and tax;
      • for internal investigations, compliance, audit or security purposes including without limitation for crime detection, prevention and prosecution;
      • to protect or enforce our rights under any agreements which the CHEMSAIN GROUP OF COMPANIES is a party to;
      • to comply with the CHEMSAIN GROUP OF COMPANIES's legal and regulatory obligations in the conduct of its business including to meet any disclosure requirements of any law binding upon;
      • for general administrative and management purposes; and/or
      • for all other purposes in relation or incidental to the above.
  6. DISCLOSURE
    1. CHEMSAIN GROUP OF COMPANIES will not sell any of your personal information to third parties.
    2. As a general rule, we will not use or disclose Personal Data about an individual other than for its primary purpose of collection, unless:
      • The individual has consented to the use or disclosure.
      • The use or disclosure is required or authorized by or under law.
      • The use or disclosure is reasonably necessary for a specified purpose by or on behalf of a regulatory or enforcement body.
    3. To facilitate the purposes hereinstated, we may disclose your Personal Data to the following classes of third parties:

      • selected financial institutions (in relation to credit card applications, only as allowed by you (in cases of joint campaigns and promotions));
      • our approved agents, affiliates, suppliers, vendors, business partners, advisors, auditors, consultants, contractors, products and service providers, only on a need to know basis;
      • regulatory authorities, enforcement agencies and any relevant parties in connection with any legal proceedings; and/or
      • any actual or potential assignee, transferee or acquirer of the company or pursuant to any corporate restructuring exercise.
  7. ACCURACY OF DATA
    1. We are dedicated to ensuring the accuracy, security, protection, and confidentiality of the personal information you provide to us. However, it is your responsibility to make sure that all personal information provided to us and kept by us is true, not misleading, updated, and comprehensive in all respects.
    2. For the avoidance of doubt, you agree that we, CHEMSAIN GROUP OF COMPANIES, and/or any of our employees, duly authorised officers, or agents, are not liable for any personal information you provide to us that is untrue, misleading, incomplete, or out-of-date.
  8. SECURITY OF YOUR PERSONAL DATA
    1. The security of your personal information is of great importance to us. We ensure the protection of your personal data by implementing physical and electronic measures, as well as enforcing management procedures.
    2. We will use all reasonable endeavors to ensure that the processing of your Personal Data is carried out in the following manner:
      • your Personal Data is only processed by our authorized personnel;
      • we maintain physical security such as locks and security systems over Personal Data that are being kept in paper and electronic data stores, and on our premises;
      • we maintain computer and network security such as the use of anti-virus programs, passwords etc;
      • we maintain and monitor our online security systems to ensure your Personal Data is protected; and /or
      • we will reasonably endeavor to impose strict conditions of confidentiality, similar levels of security safeguards and ensure the same level of obligations on our service providers or other data processors that may process your Personal Data.

    1. When you visit our website or use our services through our web portal, our web portal may create a “cookie”.
    2. A “cookie” is a piece of information stored on our hard drive containing information from your computer, such as the cookie ID which stores the information of an individual user and your preferences on our website.
    3. The “cookie” enables our system to recognise your browser and remember your name and billing information and other information so that you won’t have to retype it on your next visit.

  11. HOW LONG IS YOUR PERSONAL DATA BEING KEPT BY US
    1. The duration for which we keep your personal information depends on its type and purpose of use for providing you with information or services. If the information is anonymous or made anonymous through processing, we may keep it for longer periods for trend analysis.
    2. We are also bound by legal, tax, regulatory and industry requirements or guidelines for keeping records and retention of your Personal Data.
  12. ACCESS, CORRECTION REQUESTS AND INQUIRIES
    1. Subject to any exceptions under applicable laws, you have the right to:
      • Request for access to, request for a copy of and request to update or correct your Personal Data held by us;
      • Request us to limit the processing of your Personal Data (for example, requesting us to stop sending you any marketing and promotional materials or contacting you for marketing purposes);
      • Request to enquire about your personal data; or
      • You are no longer agreeable to us to keeping, holding, or storing your personal information. Please be aware, however, that this might prevent us from properly carrying out or fulfilling the obligations we have to you with regard to the purposes abovementioned.
